These terms and conditions regulate the business relationship between you and us. By using our website in any way, or by buying from us, you agree to be bound by them. No person under the age of 18 years may purchase goods. We look forward to seeing you again when you are over 18.

1. DEFINITIONS

In this agreement:

 

  • “Carrier” means any person or business contracted by us to carry goods from us to you.

     

  • “Consumer“ means any individual who, in connection with this agreement, is acting for a purpose which is outside his business.

     

  • “Content“ means any content in any form published on our website by us or any third party with our consent.

     

  • “Goods“ means any of the goods we offer for sale on our website, or, if the context requires, goods we sell to you.

  • “Post“ means display, exhibit, publish, distribute, transmit and/or disclose information, Content and/or other material on to our website.

2. INTERPRETATION

2.1. A reference to a person includes individuals, partnerships, corporations, or organisations. 2.2. These terms apply to all supplies of goods by us and prevail over any terms proposed by you. 2.3. Any obligation of any person arising from this agreement may be performed by any other person. 2.4. These terms apply to you as a buyer or prospective buyer and, where the context allows, as a visitor to Our Website. 2.5. This agreement is made only in the English language.

3. THE CONTRACT

3.1. This agreement contains the entire agreement between the parties. 3.2. We do not guarantee that all goods advertised on our website are available. We may change these terms from time to time. The terms that apply to you are those posted here on the day you order. 3.3. The price of goods may be changed by us at any time, but will not affect a price already charged to you at the time of purchase. 3.4. We do not sell goods in all countries. We may refuse delivery if you live in a country we do not service.

4. ACCEPTANCE OF YOUR ORDER

4.1. Your order is an offer to buy. Acceptance occurs only when we confirm in writing (via email). 4.2. If items are out of stock, we will offer alternatives which you may accept or cancel.

5. PRICE AND PAYMENT

5.1. No Goods will be shipped until payment has been received in full. 5.2. Prices include Australian Goods and Services Tax (GST). 5.3. If we have under-priced goods by mistake, we are not liable to supply them at that price, provided we notify you before dispatch. 5.4. Delivery charges are displayed on our website before you pay. 5.5. Refunds will be credited to your original payment method as soon as practicable.

7. DELIVERY AND COLLECTION

7.1. Subject to payment, goods are generally delivered within 30 days. 7.2. All goods must be signed for on delivery by an adult aged 18 years or over. 7.3. If a package is not signed for, liability transfers to you. We are not responsible for theft or damage after a missed delivery attempt. 7.4. You may collect goods from our premises by prior appointment only, provided payment has been cleared via our online gateway.

8. FOREIGN TAXES AND DUTIES

8.1. If you are outside Australia, you are responsible for all local taxes, duties, and import laws.

9. RETURN OF GOODS

9.1. Goods must be returned as soon as a defect is discovered, but no later than 30 days after purchase.

9.2. Notification must be via email (support@watchdrop.com.au).

9.3. Change of mind returns are at your own risk and cost.

10. DEFECTIVE GOODS

10.1. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

11. DISCLAIMERS

11.1. Subject to the Australian Consumer Law, we give no additional warranty regarding the quality or fitness of goods for a particular purpose. 11.2. Our liability is limited, to the maximum extent permitted by law, to the value of the goods purchased.

12. YOUR ACCOUNT WITH US

12.1. You are responsible for maintaining the confidentiality of your account and password.

13. SECURITY OF OUR WEBSITE

13.1. You agree not to modify, copy, or damage any portion of our website or collect information such as product listings and prices for unauthorized use.

14. INDEMNITY

14.1. You agree to indemnify us against all costs and claims arising from your breach of this agreement or any act of neglect.

15. INTELLECTUAL PROPERTY

15.1. We defend all intellectual property rights in connection with our goods and website content (text, graphics, logos, images). You may not reproduce or exploit this content without consent.

16. MISCELLANEOUS MATTERS

16.1. Email communications are contractually binding. 16.2. If any provision is held invalid, it shall be modified only to the extent necessary to make it enforceable. 16.3. Any dispute shall first be attempted to be settled via good faith mediation. 16.4. The validity and performance of this agreement are governed by the laws of the State of Tasmania.
